Exciting changes... Early October 2008
www.donotcall.ca
launches it's "Directory of Exempted Telemarketers & Solicitors".
The directory prominently displays organizations, charities and
newspapers who are exempt from using the National donotcall Registry.
These exempted organizations must maintain specific in-house donotcall
lists as per the provisions/restrictions provided in Bill C-37.
Survey companies have special provisions within Bill C-37 allowing them
to operate without an in-house donotcall list as they are not selling
anything, however they must recognize the "Privacy Act" and your
reasonable request of privacy
Public members who have registered may add to the
directory at
will. This directory and it's members will help Canadians easily find
contact information of the exempted organizations to specifically request
removal from individual call lists.
Companies and organizations for profit and not for profit
have been required to maintain in-house donotcall lists prior to Bill C-37
passing into law, however the general public has stated that the simple
request to be removed from individual call lists has been ineffective.
www.donotcall.ca will now provide
3rd party documentation for these individual requests. This
valuable service is free of charge to
all registered donotcall.ca members. Now for the very first time
in Canadian history accountability is present for all telemarketers,
solicitors and survey groups regardless if they're exempt from the National
Donotcall Registry.
Exemptions
of Bill C-37
(Groups
that are not required to use the government controlled donotcall
registry)
-
MP's are exempt.
-
Print media
(subscription type news papers) are exempt.
-
All charities
are exempt.
-
All companies of
whom you deal with are exempt.
-
All survey and
research companies are exempt.
-
WOW...THE PHONES
ARE GOING TO RING!
The good part
of bill C-37 is clear, if you ask the telemarketing company,
organization or charity to never call you again...then your name and
number will be added to that companies donotcall list. This rule
has been in place for many years, does it work???
According to
your feedback here is the "best of the bad list" of groups that violate
your privacy:
-
Charities
--- exempted from registry.
-
Survey and
Research Groups --- exempted from registry.
-
Newspapers--- exempted from registry.
-
Energy
Resellers--must use the Federal DoNotCall Registry.
-
Current
relationships i.e. your bank --- exempted from registry.

IF you haven't read this interesting legislation coverage from Michael Geist...then you should.
Canada's Do-Not-Hesitate-To-Call List.
Previously posted on donotcall.ca 2004
Telemarketing calls to your home will reduce when
legislation becomes law or fails to become law. If legislation
fails to become law, donotcall.ca will
proceed with our independent business plan (and it's free also) to prevent telemarketers from calling your home. Canada will have a do not call registry with or
without legislation.
Canadians should be concerned
with donotcall legislation.
It's
certainly disconcerting to hear that telemarketing will more than likely
be controlled by Federal Legislation. Please don't misunderstand me;
I’m no different than most Canadians who particularly don't care for
telemarketing. However we decided to approach the growing concern and
developed a business plan to tackle this problem as a private
enterprise. The business plan provides free registration for all
Canadians and free basic services for all small businesses. Our model
creates an equal playing field for all businesses large and small while
providing maximum privacy for all Canadians. The new proposed
legislation however, may not...Canadians please be careful, underneath
the red candy coating this apple could be spoiled rotten!!!
Our
plan provides all willing Canadians several options unlike any donotcall
service in the world. I'm proud of the work we've completed and it
truly displays to the world a positive outlook for Canada...it is
another opportunity for the Canadian people and businesses to shine as a
free, peace keeping nation.
On
Dec 9th I sent John Gustavson of the Canadian Marketing Association an
e-mail presentation stating benefits we can offer businesses. I
was pleased to see his comments within recent press coverage quoting
"businesses should know it's better to contact them through mail or
internet" and another quote "we think it's going to mean better
targeting of marketing dollars" both similar concepts within our own
presentation.
However I'm really uneasy with one comment that Mr. Gustavson was quoted
on "People are entitled to some relief" the word SOME is unsettling.
I can't seem to get over the fact that the CMA has opposed
legislation in the past...What's changed???
All
Canadians, small businesses and future new businesses should be
concerned with this legislation as it could create unfair competition
and have minimal impact on calls being received. The "Big Boys"
(large companies) could in fact have a "license to call" while all small
and future businesses are
restricted. The legislation, as presented in the media, will allow
businesses to call their current clientele to introduce new products and
services. As small or new businesses have few to no contacts the new
legislation could eliminate all chances of an equal playing field. This
creates unfair competition and fails to encourage new business, growth
and development. In other words, when the "Big Boys" see the small
companies more
efficient idea, service or product the large companies can adapt quickly
and call all their customers today, while the small companies are still knocking on doors or sending mail.
I
strongly encourage all Canadians, MP's, the CRTC and the Competition
Bureau to speak-up and ensure that the final legislation treats all
businesses fairly and equally now and in the future.
Donotcall.ca's future is clear; we will help to ensure legislation is
fair for all. We will apply to manage and administer the database under
the CRTC. In the event the proposed legislation does not pass into law;
we will ensure that Canadians still have a successful donotcall
registry.
Respecting you,
Denis Belisle
